A Ballarat magistrate has decided a diabetic driver who crashed into a Daylesford beer garden, killing five people, will not go to trial.
67-year-old William Swale walked free from court yesterday, after all charges relating to the crash were dropped.
The newsroom understands the magistrate found the evidence against Mr. Swale was ‘so weak’, the chances of his conviction was minimal.

Mr. Swale’s defence claimed he suffered a severe hypoglycemic attack when he crashed into patrons at the Royal Daylesford Hotel in November last year.
